Part A — Terms of Service
1. Agreement to these Terms
1.1 These Terms of Service ("Terms") are a binding agreement between you and Vector K LLC, a California limited liability company doing business as FaxItIn ("FaxItIn," "we," "us"). They govern your use of faxit.in, faxitin.com and the fax-sending service offered there (the "Service").
1.2 You accept these Terms by checking the agreement box and submitting a fax. If you do not agree, do not use the Service. If you use the Service on behalf of a business, you confirm you are authorized to bind that business, and "you" includes it.
1.3 Please read Section 8 carefully. It requires most disputes to be resolved by individual binding arbitration and waives class actions and jury trials.
1.4 We may update these Terms. Each fax is governed by the version you accepted when you submitted it. A change does not apply to faxes already submitted. The current version and its effective date are always posted at https://faxit.in/terms.
2. The Service and who can use it
2.1 What we do. FaxItIn lets you upload a document, pay for it, and send it as an outbound fax to a fax number you enter. We do not receive inbound faxes. We transmit faxes through third-party telecommunications providers.
2.2 No account. You do not need an account. Each fax is a separate, one-time purchase. After upload we show you a private tracking link for checking the fax's status. Anyone with that link can see its status, so keep it private. Tracking links expire after [48 hours].
2.3 Limits. At launch we send only to fax numbers in the United States and Canada. Each fax may have up to 30 pages and a file size of up to 20 MB, in the formats we list on the site. We may change these limits at any time. A change will not affect a fax already paid for.
2.4 Eligibility. You must be at least 18 and able to form a binding contract. You may not use the Service if you are barred from it under applicable law.
2.5 Changes and availability. We may change, suspend or discontinue any part of the Service. We do not promise the Service will be available at all times or free of errors.
3. Prices, payment and refunds
3.1 Price shown first. We show you the full price before you enter payment details. It is based on the page count of your file [currently $3.49 for up to 5 pages plus $0.25 per additional page, in US dollars]. Prices include applicable taxes.
3.2 Authorize now, charge only on success. When you submit, we place a temporary authorization on your card for the quoted amount. We capture (charge) it only if your fax is successfully delivered (Section 5).
3.3 Failed faxes are not charged. If your fax cannot be delivered after our automatic retries (Section 4.3), we void the authorization and you are not charged. Your bank decides how fast the hold disappears, usually within a few business days.
3.4 Refunds after delivery. Our delivery record from the telecommunications provider is the basis for refund decisions. We generally do not refund a fax that our records show as delivered. That includes cases where the recipient says pages were unreadable or missing, or that the wrong number was entered.
3.5 Payment processing. Payments are processed by Stripe, LLC. We never see or store your full card number. Your use of Stripe, LLC is also subject to Stripe's terms.
3.6 Chargebacks. Please contact us before disputing a charge. We may answer a chargeback with our delivery records and any receipt we sent you.
4. Your documents: deleted, not kept
4.1 Ownership. You keep all rights to your documents. You give us only a limited right to process, scan, convert and transmit each document to send your fax.
4.2 Deleted unpaid uploads. If you upload a document and don't pay, we delete it within 60 minutes.
4.3 Deleted after sending. We keep a paid document only while we try to send it. We delete it as soon as the fax succeeds or fails for good, and in any case within about 60 minutes of upload. During that window we may retry automatically if the line is busy or doesn't answer. If the fax still hasn't gone through when the window closes, it counts as failed.
4.4 We cannot resend, recover or prove content. Because we delete your document, we cannot:
- resend it, or retry it after the 60-minute window;
- give you a copy of it; or
- provide proof of what was sent.
If you need a record of what you sent, keep your own copy. To send again, you must upload the document again and pay again.
4.5 What we keep. We keep limited transaction records (Part B, Privacy Policy). These include the destination number, time, page count, delivery status and price. They do not include the document's contents. We may use these records to support you, to handle disputes and to prevent abuse.
4.6 Our providers. Your document passes through our hosting and telecommunications providers while it is being sent. We choose providers and settings that don't keep a stored copy. However, we do not control their systems.
5. What "delivered" means
5.1 A fax is "delivered" when our telecommunications provider reports that the receiving fax machine or service accepted the transmission. That status, as recorded in our systems, is final for billing and refunds.
5.2 Delivery confirmation does not guarantee that:
- every page printed or arrived readable;
- the recipient's machine had paper or memory;
- the number you entered belongs to the person you meant; or
- anyone has read, received or acted on the fax.
5.3 We do not guarantee that any fax will be delivered, or delivered by a deadline. Busy lines, recipient equipment and carrier networks are outside our control. Do not rely on FaxItIn alone for time-critical or legally required filings.
5.4 Optional email receipt. If you give us an email address, we send exactly one message: a confirmation of delivery and the amount charged, or a notice that the fax failed and you were not charged. We do not keep your email address after sending it (Part B). We cannot resend receipts.
6. Acceptable use
6.1 Your responsibility. You alone are responsible for each fax you send: its content, the destination number, and your right to send it.
6.2 No junk faxes. You may not send unsolicited advertisements. Each time you send, you confirm that you have permission, or a lawful basis, to fax that number. You also confirm that the fax complies with the Telephone Consumer Protection Act (47 U.S.C. § 227) and the Junk Fax Prevention Act, including any required opt-out notice, and with similar laws elsewhere.
6.3 Prohibited uses. You may not use the Service to:
- send content that is illegal, threatening, harassing, defamatory, obscene or fraudulent;
- impersonate any person or organization, or misrepresent who sent a fax;
- repeatedly fax a number to harass or overwhelm the recipient;
- send files containing malware, or files designed to disrupt our systems or the recipient's equipment;
- fax premium-rate or high-cost numbers, or otherwise commit telecommunications fraud;
- use a payment card you are not authorized to use, or test stolen cards;
- break into, overload, scrape or reverse-engineer the Service, or get around our limits or security checks; or
- break any law or infringe anyone's rights.
6.4 Not for health records. FaxItIn is not designed for HIPAA compliance. We do not sign Business Associate Agreements. Covered entities and their business associates may not use the Service to transmit protected health information. Other users who choose to fax their own health information do so at their own risk.
6.5 Enforcement. We may scan, block, delay, refuse or stop any fax, and void the related authorization, if we reasonably believe it violates these Terms. We may also cooperate with valid legal requests and preserve the related transaction records. We apply rate limits and fraud checks, and we will not explain why a particular fax or payment was declined.
6.6 Reporting abuse. If you received an unwanted or abusive fax sent through FaxItIn, report it via our Contact Us form with the receiving number and the approximate time.
7. Disclaimers, limits on liability, indemnity
7.1 Disclaimer. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED. THESE INCLUDE MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT A FAX WILL BE DELIVERED, ON TIME, OR READABLE.
7.2 Limitation of liability. TO THE FULLEST EXTENT THE LAW ALLOWS, FAXITIN AND ITS MEMBERS, MANAGERS AND PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES. THAT INCLUDES MISSED DEADLINES, LOST DEALS, LOST PROFITS AND LOST DATA, EVEN IF WE WERE TOLD THEY WERE POSSIBLE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE FAX THE CLAIM IS ABOUT, OR (B) US $50.
7.3 Some jurisdictions do not allow certain exclusions or limits, so parts of 7.1 and 7.2 may not apply to you. Nothing in these Terms limits liability that the law does not allow to be limited.
7.4 Indemnity. You will defend, indemnify and hold harmless FaxItIn and its members, managers and providers against all third-party claims, fines, damages and costs (including reasonable attorneys' fees) arising from your faxes, your breach of these Terms, or your violation of any law or of anyone's rights. This includes TCPA and junk-fax claims.
8. Disputes, governing law and general terms
8.1 Contact us first. Before filing a claim, let us know via Contact Us form with a description of the problem. We'll try to resolve it within 30 days.
8.2 Binding individual arbitration. Any dispute about the Service or these Terms that we can't resolve informally will be decided by binding arbitration. The arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules, and the Federal Arbitration Act governs this clause. Either party may instead bring an individual claim in small-claims court if it qualifies. Either party may also seek an injunction in court for infringement or misuse of intellectual property.
8.3 No class actions or jury trials. Claims may be brought only on an individual basis, not as a plaintiff or class member in any class, consolidated or representative proceeding. You and FaxItIn each waive the right to a jury trial. If this class waiver is found unenforceable for a claim, that claim will be heard in court, not arbitration.
8.4 Opt out. You may opt out of arbitration by emailing us via Contact Us form within 30 days of first accepting these Terms. Include the date and the last four digits of the card you used.
8.5 Governing law and venue. California law governs these Terms, without regard to its conflict-of-law rules. Any matter that goes to court will be heard in the state or federal courts of Santa Clara County, California.
8.6 General. These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If a provision is unenforceable, the rest still applies. If we don't enforce a provision, we haven't waived it. You may not transfer these Terms; we may transfer them along with our business. Neither party is liable for delays caused by events beyond its reasonable control, including carrier or network outages.

Part B — Privacy Policy
9. What we collect and how long we keep it
We collect as little as possible to send your fax and prevent abuse. We do not sell or share personal information for advertising, and we show no ads.
| Data | Why we use it | How long we keep it |
|---|---|---|
| Your document | To send the fax | Deleted within about 60 minutes of upload, or within 60 minutes if you don't pay (Terms §4) |
| Email address (optional) | To send your one receipt or failure notice | The plain address is never stored. After sending, we keep only a one-way keyed hash, used to spot repeat abuse and check disputes |
| Destination fax number, time, page count, delivery status, price | Billing, support, disputes, abuse reports | 3 years, for accounting and legal purposes |
| IP address | Rate limits and fraud prevention | Hashed address for up to 150 days, in rate-limit counters. After that, kept only in shortened or hashed form, alongside the transaction record |
| Random device ID (a first-party cookie or local-storage value) | Rate limits and fraud prevention | Stored on your device. You can clear it at any time |
| Card "fingerprint" from Stripe (not your card number) | Fraud prevention and per-card limits | Kept with the transaction record |
| Tracking link, saved in your browser | Lets you see an in-progress fax if you return | Cleared shortly after the fax finishes. The link itself expires after 48 hours |
What we never collect: an account, a password, your name (unless it appears in your document), or your full card number. Stripe, LLC collects your card details directly under its own privacy policy.
Contents are never logged. Our analytics and error-monitoring tools are set up so that they never receive your document, file name, destination number or email.
10. Service providers, cookies, your rights, contact
10.1 Service providers. We share data only with providers that help us run the Service, and only as much as each one needs:
| Provider | What it does for us | What it receives |
|---|---|---|
| Telnyx | Sends the fax | Document, destination number |
| Stripe | Payments and fraud screening | Card details (directly from you), amount, IP |
| Vercel, Supabase, Railway, Upstash | Hosting, database, processing, rate limits | Data needed for each step, kept for the times in Section 9 |
| Resend | Sends your optional receipt email | Email address, fax status, amount |
| PostHog | Cookieless, anonymous product analytics | Page views and funnel events. No IP, contents, numbers or email |
| Sentry | Error monitoring | Technical error data, with contents removed |
We may also disclose records if the law requires it, such as for a valid subpoena or court order. We may disclose them to protect the Service or other people from fraud or abuse, or to a successor if our business is transferred.
10.2 Cookies and local storage. We do not use advertising or cross-site tracking cookies, and our analytics is cookieless. We store only two items in your browser: a random device ID for abuse prevention, and the tracking link for an in-progress fax. Because we don't track you across sites, we treat Global Privacy Control and Do Not Track signals as already honored.
10.3 Your California and other privacy rights. You may ask to know, correct or delete personal information we hold about you. We don't sell or share personal information, so there is nothing to opt out of. We don't use accounts, so we can usually locate records only from details you give us, such as the destination number, date and amount, or the email you used. We may have to keep some records for legal, accounting or fraud-prevention purposes. We will not discriminate against you for using these rights. Send requests to privacy@faxit.in.
10.4 Security. We protect data with encryption in transit, strict access controls and short retention. No system is perfectly secure.
10.5 Children. The Service is not intended for anyone under 18, and we do not knowingly collect their information.
10.6 Where data is processed. We and our providers process data in the United States.
10.7 Changes. We'll post any update here with a new effective date. If a change materially affects how we handle data we have already collected, we'll put a notice on the site.
